In order to spell out the proper expectations from both clients, potential clients, and Great Pond Design, all clients and potential clients must read these terms in full, and if in agreement, fill in their name, email address and submit the form at the bottom of this page.

Great Pond Design will not schedule or perform services prior to the agreement to these terms.

  • Maintenance plans are available in 6 and 12 month intervals only. They can be purchased on our Maintenance Plans page (or if you’re looking for security only, on this page) using a debit card, credit card or PayPal. After we receive payment, your plan will start on the 1st of the following month. If you prefer to pay via check, please contact us.

  • A maintenance plan is required for any/all website updates or maintenance to be performed by Great Pond Design. This does not apply to bug fixes to a website that we created within the last 90 days, and you may also inquire for one-off availability, though it is generally limited.

  • Note, we cannot be responsible for bugs due to a third parties involvement, or the incompatibility of future theme and plugin updates as these are in the hands of the theme and plugin authors. However, with a maintenance plan, in the event of a theme or plugin bug, we can restore a previous functioning version of your themes and plugins, as well as consulting for alternative methods.

  • Often it is sooner, but please allow 2 weeks for updates/maintenance requests.

  • To keep our sanity, unused hours for updates/maintenance will expire at the end of the month and cannot be rolled over into future months.

  • Dedicated updates and maintenance time, as well as approved one-off updates for outside clients and maintenance is billed at a minimum of a quarter hour.

  • Updates/maintenance requests are for website updates only. For example, we will not perform marketing tasks including Facebook updates or Email / Newsletter campaigns. These are tasks which we feel should be handled internally by a full time staff member and/or a marketing specialist. We do offer SEO packages, which you can view here.

  • We do not support email issues. We strongly recommend you setup your email with Google Apps for Work and/or another reliable platform which has 24/7 support.

  • Website outages that are a result of an issue with your web hosting company may require extensive support time. In these scenarios, it may be most cost effective for you to speak directly with your hosting company. As an alternative (and with your permission) we can work directly with your web host through email, phone, or support tickets to remedy an outage – time spent will be deducted from your maintenance plan’s monthly allotment and then billed at our regular hourly rate of $80.00 for any overages.

  • We have an excellent track record with website security, but no website (especially WordPress powered sites) is 100% immune to being hacked or targeted by spambots. In the event of a breach, we will work to the best of our ability to restore a hacked website in a timely manner. We also strongly urge our clients to set strong passwords and change them often! Not only for WordPress, but for your hosting panel and FTP account(s) as well.

  • Maintenance plans are currently available for WordPress powered websites only.

  • Phone and email support may take 48-72 hours and applies to business hours only. Regular business hours are Monday through Friday, 9am to 5pm EST.

  • As the web and technology world is always fast-evolving, these terms are subject to change at anytime at the sole discretion of Great Pong Design. Additional terms of service apply as displayed in the scrolling window below.

Great Pond Design agrees to perform services to the best of their ability. This includes building a new website, rebuilding an existing website, as well as maintenance for an existing or newly created website. Goals and strategies for new websites are to be carried out by Great Pond Design as discussed via email, PDF proposal and/or general statement of work provided by Great Pond Design to Client.

Given the nature of web development, WordPress, and fast-moving technology including browser updates, theme updates and plugin updates, bugs and outages are always a possibility and work cannot be guaranteed as error-free – whether at the fault of Great Pond Design or other means including hosting outages. New builds are tested in the latest versions of Chrome, Firefox, Safari, and Edge.

Great Pond Design performs all website builds and maintenance plans with best intentions in respect to Client’s image, reputation, and profitability. Great Pond Design cannot be responsible for Client loss in revenue or sales, under any circumstances.

Sales of new website builds and maintenance plans are final and Great Pond Design is not responsible should Client sell their business, declare bankruptcy, or otherwise willing or unwillingly terminate their involvement in this agreement.

Great Pond Design reserves the right to terminate this agreement in the event of Client supplying unethical materials including but not limited to pornography, obscenity, nudity, violations and infringements of privacy, computer viruses, malware, spamming, harassment, any illegal activity, and/or advocacy of an illegal activity. Any action by Client that could be considered abusive or unethical is a violation of this agreement and Great Pond Design reserves the right of termination of this agreement.

Client will supply Great Pond Design with all text, documents, and other necessary materials for building and maintenance, as applicable to the project. Client affirms that they are the full copyright owner of any such provided materials. Client will indemnify Great Pond Design and hold Great Pond Design harmless against any claims of libel, copyright, or trademark infringement brought against Client with respect to use of those materials.

Licensed stock photos and videos may be supplied by Great Pond Design to Client at the rate of $10.00 per file.

On-site photo shoot with Great Pond Design photographer may be arranged at Client’s request for a fee of $400.00 for one mutually agreed upon day/location which includes approximately 2-4 hours of shooting. On-site photo shoot includes one-time post production editing of photos at photographers sole discretion. Photoshoot fee does not include travel costs, which are billed at $1.50 per mile from photographer’s Portland, Maine studio.

Client receives full rights including the editing of the design, graphics, photos, text, and source code contained in the finished assembled website, except where prohibited by plugin or theme authors.

Great Pond Design and its subcontractors retain the right to display graphics and other web design elements as examples of their work in their respective portfolios. Example work as displayed in a portfolio may be modified in good faith at the sole discretion of Great Pond Design.

The terminology of this agreement uses “Great Pond Design” which is represented by Ryan O’Connor. If/when Client submits a 1099-MISC to the Internal Revenue Service, they shall utilize section #7 “Nonemployee compensation”. Great Pond Design will provide Client with W9 for tax purposes at Client request.

In the event of a dispute remaining unsettled, the law governing these terms of service and any agreement made incorporating the same shall be resolved in the courts in Maine, United States of America.

By entering my name below, I hereby agree to all terms of service outlined above and understand that this digital agreement is a legally binding contract between myself and Ryan O’Connor, represented as “Great Pond Design”. I am the business owner or have owner-permission to act on their behalf through the terms of service outlined within this agreement.
